A Certificate of Occupancy is a legal document (Statutory Title) that states the rights granted an individual or entity by the Governor to hold and use land in Nigeria. It is obtainable through property registration or assignment of statutory or customary rights, with the Governor’s Consent.

Government Allocations

Members of the public (Nigerian Citizens) can apply and be considered for Plot Allocation on Government Layouts by completing the Application for Direct Allocation (A.D.A) which is submitted along with the Applicant’s Tax Clearance Certificate (TCC) and Means of Identification (NIN, Voters Card, International Passport etc)

Caveat

This is a notice to or through the Lands Authority (Registry) and/to the public conveying a Warning, Stipulation or Restrictions on a property/land title by the holder, attorney, administrator or relevant authority, vacation of which is subject to defined conditions.

Re-Certification

Holders of subsisting statutory titles who require re-issuance or conversion may be given a new Certificate of Occupancy, upon payment of all bills on the title (e.g Ground Rents) and completion of relevant Recertification Forms (RCI or RCO) and a prescribed fee.

Letter of Transfer

Government Allocations or Customary Rights (Traditional or Community Allocations) can be transferred through a Transfer-Application Form/Letter signed by the allottee. Affidavits or Elders’ Consent may also be required.

Survey

A Survey provides a detailed description or analysis of a specific parcel of land. It is carried out by a licensed surveyor and can, upon checking and authorization of the Surveyor-General, be filed for the grant of title or such other purposes.

Deeds of Assignment

A legal document that transfers interest/ownership of a property/land title from one person or entity to another and registered at the Lands Registry for the Governor’s Consent.

Deeds of Legal Mortgage

This document transfers a land title/property to a lender as security for a loan. It contains details of the loan, the parties and the property which is given as collateral as well as the release conditions. It is also registrable at the Lands Registry.

Deeds of Release

This releases the land title/property from the obligations of mortgage when the loan is paid off or the terms of mortgage have been satisfied.

Deeds of Lease/Sublease

A document of Contract between a landlord and tenant, outlining the terms of lease, which gives the tenant the right to use the land/property for a duration and purpose in exchange for rent. The Governor’s Consent to lease a title is obtained upon registration.
